Man Receives Multiple Felony Charges After Avoiding Checking Station

On Monday, May 20th, 2024, Officers with the Morganton Department of Public Safety were conducting a motor vehicle checking station on E Meeting Street near Huffman Street. At approximately 9:50pm, a Red Honda passenger car attempted to avoid the checking station and also committed several motor vehicle violations. Officers were able to catch up to the vehicle and perform a vehicle stop to further investigate. After completing the investigation, officers arrested Enrique Jose Pascual, 36, of Morganton. Pascual was charged with the following offenses:

 

  • Driving While Impaired
  • Habitual DWI (Felony)
  • Felony Possession of Schedule VI Controlled Substance
  • Driving While License Revoked

 

A records checked revealed that Pascual had been convicted of misdemeanor DWI on at least three occasions within the previous ten years. Under North Carolina General Statute 20-138.5,  A person commits the offense of habitual impaired driving if he drives while impaired as defined in G.S. 20‑138.1 and has been convicted of three or more offenses involving impaired driving as defined in G.S. 20‑4.01(24a) within 10 years of the date of this offense. The vehicle that Pascual was operating was also seized under North Carolina General Statute 20-28.3.

 

Pascual was transported to the Burke County Magistrates office where he received a $10,000 secured bond. Pascual’s first court appearance is scheduled for May 21, 2024.
